Before launching any Family Takaful plan, the board reviews the product design, legal documentation, and operational workflows. They ensure the Takaful Membership terms comply with Islamic contract law. During operations, the board conducts regular audits to verify ongoing compliance.
If the operator inadvertently engages in a non-compliant transaction, the board mandates the purification process, requiring the operator to donate the impure income to charity. This continuous oversight guarantees that participants receive genuine Halal protection.
The legal structuring of the Takaful operation plays a vital role in maintaining compliance. Adamjee Window Takaful utilises the Waqf model, which involves creating an Islamic endowment. The participants’ Tabarru contributions form the Waqf Fund. Once contributed, these funds belong to the Waqf, and the participants become the beneficiaries of this endowment.
To manage this fund, the operator enters into a Wakalah (Fee-based Model) agreement. The operator acts as an agent (Wakil) responsible for managing the Tabarru' pool, processing Benefits, and handling administrative tasks. In return, the operator receives a transparent Wakalah Fee (Management Fee). This clear separation of roles prevents the operator from mixing its own funds with the participants' funds, ensuring complete transparency and adherence to Islamic agency laws.
Generating Shariah-compliant Investment Returns requires strict screening of investment opportunities. The operator invests the Participant Takaful Fund (PTF) exclusively in Halal equities, Sukuk (Islamic bonds), and Islamic bank deposits. The Shariah Supervisory Board screens potential investments based on two main criteria: business activity and financial ratios.
The board ensures the companies do not engage in prohibited activities such as alcohol production, conventional banking, or gambling. Furthermore, the board analyses the financial statements of these companies to ensure their interest-bearing debt and non-compliant income remain below specific thresholds. If a company fails these screens, the operator divests from it immediately. This rigorous screening process ensures that the wealth generated for the participants remains entirely Halal.
Insurance companies globally use reinsurance to protect themselves against catastrophic losses. In the Takaful industry, conventional reinsurance involves elements of Riba and Gharar, making it non-compliant. To maintain Shariah compliance, Window Takaful Operators utilise Retakaful, the Islamic equivalent of reinsurance.
Retakaful operates on the same principles of mutual assistance and Tabarru' as primary Takaful. The operator transfers a portion of the risk to a Retakaful operator, contributing from the Participant Takaful Fund. In the event of a massive Benefit payment, the Retakaful operator provides financial support from its own cooperative pool.
